These Terms of Use ("Terms") govern your access to and use of the PYT: Pass Your Test mobile application (the "App"), operated by Next Level Labs LLC ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
The App is intended for individuals preparing for professional certification exams and is not directed at children under the age of 13. By using the App, you represent that you are at least 13 years old and able to form a binding contract.
2. Accounts
Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
3. Subscriptions and Billing
The App offers auto-renewing subscription plans as well as optional multi-month plans. Subscriptions and any associated purchases are sold and billed through the Apple App Store (on iOS) or Google Play (on Android), not directly by us. Applicable pricing is shown in the App at the time of purchase.
- Auto-renewal: Auto-renewing subscriptions automatically renew for the same period at the then-current price unless canceled at least 24 hours before the end of the current billing period.
- Billing: Your account with the applicable app store is charged at confirmation of purchase and, for auto-renewing plans, at the start of each renewal period.
- Managing or canceling: You can manage or cancel a subscription at any time in your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; access continues until then.
- Free trials: Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial. Unless canceled before the trial ends, the subscription converts to a paid plan and your app store account is charged.
- Refunds: Payments are handled by the app stores and are subject to their refund policies. Except where required by law or the applicable app store's policy, payments are non-refundable.
4. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial exam preparation. You may not resell, redistribute, or provide access to the App or its content to others except through an authorized organization or bulk-licensing arrangement.
5. Educational Use and No Guarantee
The App provides study and practice materials to help you prepare for certification exams. It is an educational tool only. We do not administer official exams and do not guarantee that you will pass any exam or achieve any particular result. Content is provided for study purposes and is not professional, legal, or medical advice. Always follow the protocols, guidelines, and instructions of your certifying body and employer.
6. Acceptable Use
You agree not to: (a) copy, scrape, or redistribute App content; (b) reverse engineer or attempt to extract source code; (c) share, sell, or transfer your account or organization code; (d) interfere with or disrupt the App or its security; or (e) use the App for any unlawful purpose.
7. Intellectual Property
The App, including its content, questions, design, and trademarks, is owned by Next Level Labs LLC or its licensors and is protected by applicable intellectual property laws. These Terms do not grant you any rights except the limited license described above.
8. Termination
We may suspend or terminate your access to the App if you violate these Terms or use the App in a way that could harm us or other users. You may stop using the App at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.
9. Disclaimers
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that content is complete or accurate.
10. Limitation of Liability
To the maximum extent permitted by law, Next Level Labs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, exam outcomes, or profits, arising out of or relating to your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us (or through the applicable app store) for the App in the twelve months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a new "Last updated" date. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the United States and the state in which Next Level Labs LLC is organized, without regard to conflict-of-law principles.
